In its judgment of 29 March 2021 in the case of Sébastien Germain Marie Aïkoue Ajavon v Benin, the African Court on Human and Peoples' Rights (African Court) finally clarified the legal effects of a breach of the obligation to enforce provisional measures ordered by it under article 27(2) of the Protocol of the African Court on Human and Peoples' Rights. This decision was more than welcome given the Court's long standing silence on the issue. Using a comparative approach, this case discussion examines the positions of the pan-African Court from a critical perspective. It concludes that the Court has shown a certain boldness and consistency in determining the legal consequences of non-compliance with its interim measures orders, although grey areas remain.
